Multistate

  • A bipartisan coalition of 34 attorneys general filed a remedies proposal in the U.S. District Court for the Southern District of New York seeking to require Live Nation to divest Ticketmaster and certain Live Nation-owned amphitheaters. The proposal follows a jury verdict finding Live Nation/Ticketmaster liable for anticompetitive conduct that harmed consumers and the live music industry. The coalition argues that these structural remedies are necessary to end Live Nation’s illegal monopoly, prevent it from continuing to use its amphitheater ownership to exclude rival promoters and pressure artists, and protect consumers because prior behavioral remedies failed to stop the company’s unlawful conduct.

Multistate

  • A coalition of 38 attorneys general filed an amicus brief in support of Massachusetts’ lawsuit against the prediction market platform Kalshi for offering illegal sports betting in violation of Massachusetts’ gambling laws. Primarily a sports gambling platform, Kalshi argues that the bets it offers are financial instruments that should be regulated by the Commodity Futures Trading Commission (CFTC), thus preempting state regulations and legalizing the operations nationwide. State attorneys general assert in their brief that behaviors of prediction markets like Kalshi are subject to states’ gambling laws, noting that this is a vital consumer protection issue.

Multistate

  • A multistate coalition of 21 state attorneys general filed an amicus brief in American Gas Association v. U.S. Department of Energy, urging the United States Supreme Court to reverse a D.C. Circuit decision that upheld Biden-era Department of Energy efficiency standards that the coalition argues would effectively eliminate non-condensing natural gas furnaces and commercial water heaters from the market by requiring performance thresholds that only condensing appliances can meet. The brief argues that the D.C. Circuit Court failed to independently analyze the Energy Policy and Conservation Act as required under the Supreme Court’s decision in Loper Bright Enterprises v. Raimondo.
