Multistate

  • A multistate coalition of 22 attorneys general submitted a comment letter urging the Trump Administration to withdraw a proposed information collection request associated with Executive Order 14398, “Addressing DEI Discrimination by Federal Contractors.” The proposed collection would impose reporting, recordkeeping, and information-sharing obligations on federal contractors and subcontractors in connection with a new prohibition to be included in federal contracts related to DEI activities. The coalition argued that the proposed collection would violate the Paperwork Reduction Act, that the public notice did not provide enough information for meaningful public comment and underestimated the burden on contractors, and that the proposal does not establish adequate protections for sensitive and personally identifiable information.

Multistate

  • A coalition of 17 state attorneys general filed a lawsuit against the Environmental Protection Agency (EPA), alleging violations of federal law after the agency repealed stricter limits on mercury and other hazardous air pollutant emissions from coal-fired and oil-fired power plants that were previously outlined in the Mercury and Air Toxics Standards (MATS) Rule. The coalition seeks injunctive relief to reinstate the updated emissions standards, arguing that the EPA’s action endangers public health and the environment and failed to consider advances in emissions control technologies.

  • A multistate coalition of 24 state Attorneys General filed an amicus brief urging the D.C. Circuit Court to permit EPA to rescind up to $20 billion in grants issued under the Greenhouse Gas Reduction Fund. Amici argue that the Biden-era program was “unlawfully structured, riddled with waste and conflicts of interest, and intentionally designed to evade oversight.”

Crowell attorneys attended the Democratic Attorneys General Association (DAGA) 2024 Policy Conference in Austin, Texas on May 22 and 23. As usual, the conference included receptions and other networking events allowing the Crowell attorneys in attendance to engage with the approximately dozen attorneys general in attendance, as well as a host of their respective staff.
